WHAT IS MEDIATION?
Mediation is a peaceful, structured process that helps people
communicate effectively to work through conflict and choose their
own solution. It can be used as an alternative to going to court,
during a court case, and whenever people want to resolve a
dispute. It is a conversation that a neutral professional facilitator
helps you prepare for and have with the goal of finding the best
way through the conflict for everyone involved.

Liz’s 4 Cs of Mediation
Confidentiality
The confidential setting of mediation is key for success. It provides a safe space so that you can feel comfortable talking openly, asking questions and
exploring issues while working to put conflict behind you and move on to a better future. What happens in mediation, stays in mediation with a few
exceptions (e.g. final agreements, intent to commit a felony, intent to harm a child).
Control
You, the parties, are in control of the outcome in mediation. This is an important difference between mediation and court. In court, the parties “argue”
their “side” to a judge and each party hopes the judge will agree with them. The judge is in control of the outcome and the judge’s order, that is based
on their application of the law, is imposed on the parties. In mediation, you get choose the outcome based on what is most important to you. When the
parties have control, the outcome is customized by the parties to be what works best for the parties.
Creativity
I encourage people to think creatively. Some of the best “win-win” outcomes happen when people think creatively about how to move forward. For
example, parties involved in financial disputes might find resolutions that do not involve money (What is valuable to you?). Likewise, parties involved
in a dispute over a negative experience can find resolutions through improved communication, better understanding and mutually beneficial
arrangements going forward (fences can be mended, perhaps literally).
Compassion
I became a lawyer to help people. Mediation gives me an alternative to litigation and a proven process to help people through a variety of conflicts in
ways that can be customized to work best for different parties and situations. It empowers people to tell their story with dignity and be heard in a
respectful setting. My goal is to help parties use the mediation process to find resolutions that are their best path forward to a brighter future.
About Liz Rubinstein
I am a mediator and an attorney with a unique perspective from my years lit-
igating real estate matters in Colorado, combined with my experience owning
and running a business in the pet industry with customers around the world.
I left the practice of law after about 10 years to build a family business,
GingerLead Dog Support & Rehabilitation Harnesses. It is a labor of love that
started by helping my own dog, Ginger, with her orthopedic problems. While
running GingerLead, the lawyer in me naturally paid attention to conflicts and
how they played out, as well as the impact of those conflicts on everyone
involved. I saw people in distress in many conflicts and sometimes everyone
ended up worse off after spending significant time, effort and money.
One conflict; in particular, stuck with me. It was about an animal that was loved by everyone
involved, but the people had a disagreement. It ended up in court and in addition to the time, effort,
and money; the emotional investment took a tremendous toll on everyone. After going through trial,
there were considerable negatives for both sides, and nobody was happy. I thought to myself, there
must be a better way. Then I met another attorney who mediated disputes involving animals. As
soon as she described what she did, I knew it was something I wanted to offer. I have devoted myself
to offering mediation to help people resolve conflict in the way that fits them best. I am also practi-
cing law again.
I offer mediation to help people find their way through conflict by focusing on how to move forward
with positivity and creativity. I find that in mediation people can resolve differences in less time and
less expensively than litigation. I have mediated conflicts in many different situations including those

Having spent over a decade in both the pet industry and in real estate litigation, I have a special
interest in mediations involving real estate, animals and people working with animals. With any topic,

a mediation tailored to you and your situation.
I am a Professional Member of the Mediation Association of Colorado, as well as a member of the Cen-
ter for Understanding in Conflict, the American Veterinary Medical Law Association and the Colorado
Bar Association, where I am also a member of the Alternative Dispute Resolution Section and the Real
Estate Law Section. I have mediated for Jefferson County Mediation Services and Oval Options.
